Payment Policy/Tour Waiver

The following information contains the payment, refund and cancellation policies for all tours offered by Wandering Earl Tours as well as important details, including our Tour Participation Waiver Form, regarding your participation in one of our tours:


DEPOSITS

Unless otherwise stated on the tour booking page, the following applies to all deposits paid to reserve a spot on a Wandering Earl Tour:

  • In order to reserve a spot on a tour, a deposit is required (the amount of which is mentioned on each tour booking page).

  • Once paid, the deposit is refundable for the period of time listed on the tour page or on the booking page for each tour. All deposit refund amounts will equal the total deposit paid minus a 3% transaction fee.

  • After the refund period ends, the deposit is non-refundable.

  • Deposits are non-refundable if made within 90 days of the tour start date, even if 30 days have not yet passed since the payment date.

*All deposit refunds, if applicable, will be returned to the participant via the same method the deposit was paid, minus a 3% transaction fee. It may take up to 10 business days from the date of the request for the deposit refund to be applied.


BALANCE PAYMENTS

Unless otherwise stated on the tour booking page or tour information documents sent out to tour participants who have paid a deposit, the following applies to all balance payments (the difference between the total tour cost and the deposit):

  • Balance payments are due 90 days before the tour start date

  • If a balance payment is more than 10 days late, a 6% late fee will be added on to the balance amount

  • If the full balance payment is not paid 70 days before the tour start date, Wandering Earl Tours has the right to cancel your booking without refund for any amount already paid

  • Cancellations made between 60 – 89 days before the tour start date are entitled to a 50% refund of the balance amount, minus a 3% transaction fee (the deposit is not included in the refund)

  • Cancellations made 59 days or less before the tour start date will result in a 0% refund of the balance amount

*All balance payment refunds, if applicable, will be returned to the participant via the same method the payment was made, minus a 3% transaction fee. It may take up to 10 business days from the date of the request for the balance payment refund to be applied.


DISCOUNTS/PROMOTIONS/SALES

If a discount, special promotion or sale price is being offered for any tour, only one discount can apply to a tour booking. Multiple discounts cannot be used on the same tour booking.


ADDITIONAL SERVICES

If Wandering Earl Tours arranges any additional services for a participant in connection with a tour – pre or post trip accommodation, pre or post trip excursions, additional activities during the tour, etc. – amounts paid for these services will be considered non-refundable once paid.


IMPORTANT CONDITIONS

The following conditions also apply:

Cancelled / Postponed Tour by Wandering Earl Tours

  • If Wandering Earl Tours makes the decision to cancel a tour before it starts due to any situation that we feel requires a trip to be cancelled (such as safety, not reaching the minimum number of participants, logistic issues, etc.), all participants are entitled to a 100% refund of both the deposit and the balance amount (if already paid). Wandering Earl Tours is not responsible for any other amount already paid by a participant related to the trip, including but not limited to, airfare, hotel bookings outside the trip dates, travel insurance, etc. A participant of a cancelled tour may also choose to apply the amount already paid to a new tour or a future tour offered by Wandering Earl Tours and may do so without any penalty. If a participant chooses to transfer the amount paid to a future tour, the amount paid is no longer refundable.

  • If a tour is postponed by Wandering Earl Tours, due to any situation that we feel requires a trip to be postponed, all participants may choose a 100% refund of both the deposit and the balance amount (if already paid) OR they may transfer any amount already paid to be applied to the new dates of the same tour or to another tour operated by Wandering Earl Tours. This decision must be made within 10 days of being notified by Wandering Earl Tours, via email, about the postponement. After 10 days, if no decision is made by the participant, Wandering Earl Tours will automatically apply any amount already paid to the new dates of the postponed tour.

  • If a tour is cancelled or postponed by Wandering Earl Tours and a participant chooses to transfer the amount they have already paid to a new tour or to the new dates of the postponed tour, that amount already paid will be subject to the deposit and balance payment refund policies above. The date of deposit will remain the original date the deposit was paid. The tour start date will be the new start date of the postponed tour or the start date of the new tour chosen by the participant.


Cancelled Tour by a Participant

  • If a participant decides not to participate in a tour, but the tour is still scheduled to operate as planned on the scheduled dates, the standard cancellation/refund policy at the top of this page will be applied.

  • If a participant chooses to cancel their booking on a tour, and Wandering Earl Tours decides to offer a refund or allow any amount paid to be transferred to a future tour despite the standard cancellation policy, the following applies:
    • If a participant has their payment transferred to a future tour, the amount paid will no longer be eligible for a refund.
    • The participant has 1 year to use the credit. After 1 year, if not used, the credit is forfeited.


Once a Tour Begins

  • Once a “TOUR” begins, “Wandering Earl, LLC” is unable to provide any refunds for any part of the tour. If a scheduled activity, meal or experience is not possible or is removed from the itinerary or changed to another activity, meal or experience – whether due to weather, transportation delays, natural disasters, time constraints, the decision of the tour leader and more – the cost associated with that original portion of the tour will not be refunded.
  • If a tour participant decides not to participate in any scheduled activity, meal or experience, or decides to end their participation in the tour for any reason before it is complete, no refund will be given for any missed activity, meal, experience or any other portion of the tour. In addition, no compensation will be given for any expenses incurred by a participant that decides to end their participation in the tour before it is complete. This includes expenses for accommodation, flight changes, transportation of any type, meals and more.
  • In the very rare event that a major change must be made to the itinerary and an entire destination (city, village or town) where the group planned to spend at least one night must be cancelled, we will attempt to replace that destination with a suitable alternative. Such changes are a part of travel from time to time and we are not able to provide any refunds as a result.


TOUR PARTICIPATION WAIVER

All tour participants will be required to sign our Tour Participation Waiver / Contract in order to participate in one of our Wandering Earl Tours. The content of the waiver form is also shown below for your convenience:

Tour Participation Waiver

The following should be read carefully. Agreeing to the terms below will waive certain legal rights.

In consideration of my participation in a tour offered by Wandering Earl, LLC, hereinafter called TOUR, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Wandering Earl, LLC, Wandering Earl Tours or any of its employees, subsidiaries, affiliates, contractors, or agents (hereinafter referred to as THE RELEASEES) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in such activity, while in, on or upon the premises where the activities are being conducted, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law.

HEALTH and SAFETY 
I acknowledge that my participation in a “TOUR” is completely voluntary.  I acknowledge that certain risks are inherent in the activities to be undertaken by me/us while on the tour and that inclement weather and unavailability of first aid or emergency medical treatment as well as other unknown or unanticipated risks may occur such as war or terrorism, and I accept full responsibility for such specified inherent risks and those not specifically identified. I am also aware of the physical requirements of the “TOUR” and if uncertain, I will seek medical advice to ensure that my physical condition can meet these requirements. I acknowledge that medical services or facilities may not be readily available or accessible during some or all of the time in which I am participating in the “TOUR”. I agree to follow all written and verbal rules of safety presented to me by THE RELEASEES.

By participating in this “TOUR”, I understand that there is always a potential to become ill while traveling. I am aware that Wandering Earl Tours recommends that I check with my health care provider about vaccines, medications and preparations based on my personal situation and health and the specific conditions of the destination(s) where I am traveling.

If the tour leader or any other staff involved with operating the tour deems me unfit to begin participation or continue participation in a tour due to reasons that may affect the safety or overall well-being of myself or the group, I understand that I will be required to cease my participation based on their directions. In such a situation, I understand that Wandering Earl, LLC will assist with any additional arrangements required as a result of the termination of my participation in the tour, however, I remain fully responsible for any costs associated with such arrangements.

TRAVEL INSURANCE 
I understand that Wandering Earl, LLC strongly recommends that I purchase international medical and travel insurance that covers any unforeseen medical expenses, trip cancellation and trip interruption for the journey to/from the “TOUR” and throughout the duration of the “TOUR”. If I choose not to purchase international medical and travel insurance for this”TOUR”, I understand that I may be required to pay for any or all medical expenses and/or unforeseen trip expenses directly out of pocket in order to receive treatment or other necessary services. I accept full responsibility for any expenses related to interruptions to my trip and/or expenses for medical treatment as a result of any illness or injury, during or after the “TOUR”. Expenses such as, but not limited to, accommodation, transportation and meals will be my own responsibility if I am not able to participate in the “TOUR”, continue the “TOUR” once it has started or return home on my scheduled date at the end of the “TOUR”.

ASSUMPTION OF RISKS
While Wandering Earl, LLC does not plan to expose me to any unnecessary risks, I understand that I am responsible for myself and will be expected to make my own decisions as to whether or not I participate in any activity due to circumstances that might affect my health and/or safety.  I also understand that the participation in a “TOUR” and its related activities may involve risks, dangers and hazards such as, but not limited to:

  • personal injury and/or death
  • travel to areas that might not provide access to medical treatment
  • adverse weather conditions and forces of nature
  • interactions or encounters with wildlife
  • equipment malfunctions
  • negligence of guides, drivers and/or other tour participants
  • negligence on the part of Wandering Earl, LLC or any of its partners, employees or agents
  • vehicle accidents
  • civil and/or military actions
  • terrorism
  • travel hardships if arrangements do not proceed as planned
  • separation from the group
  • other risks and/or situations not mentioned above

I AM AWARE OF THE RISKS, DANGERS, AND HAZARDS ASSOCIATED WITH THE “TOUR”.

  • I accept of my own will and fully assume these risks as part of my participation in the “TOUR”.
  • I assume all risks, whether or not foreseeable, of traveling to and from the starting and ending points of this “TOUR” (including, but not limited to, flight cancellations and/or disruptions, missed transportation connections, hardships if travel arrangements do not proceed as planned and/or missing the tour, in part or fully, for any reason.)
  • I understand that if I decide to leave the “TOUR” and end my participation in the “TOUR” before it finishes, I am not entitled to any refund for any part of the tour or for any reason whatsoever.
  • I understand the payment and refund schedule and agree to abide by those policies in terms of if, when and how much money, if anything, may be returned in the form of a refund once paid due to any changes in my desire or ability to participate in the tour.

RELEASE OF LIABILITY AND INDEMNITY AGREEMENT
I hereby forever release and discharge THE RELEASEES, and their respective directors, officers, employees, agents, legal representatives and assigns, as well as all additional parties for whom they may be acting and all additional parties who are acting with their authority and permission from all present and future claims, liability, loss, expenses, damages, costs (including without limitation medical expenses and attorneys’ fees and disbursements) arising, directly or indirectly out of any physical and/or emotional injuries to myself and/or to any family member who may be accompanying me on this trip and/or damage to my property arising out of or in connection with my participation in the “TOUR” whether the same be caused by negligence or fault on the part of THE RELEASEES or otherwise, except in the case that such injury or damage occurs as a direct result of willful misconduct.

GOVERNING LAW / CHOICE OF VENUE
I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Florida and that any mediation, suit, or other proceeding must be filed or entered into only in the state or county courts of Florida located in Palm Beach County. Any portion of this document deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the remaining provisions.

CHANGES
I understand that certain aspects of the actual tour may be different than the original advertised itinerary. Changes to the itinerary, activities, accommodations, transportation and/or meals might need to be made for any number of reasons, either before or during the tour.  While “Wandering Earl, LLC” does its best to ensure the final itinerary matches the advertised itinerary, I understand that there might be differences.

PHOTOGRAPHY
I understand that during the tour images, photos or videos may be taken by other travelers and/or representatives of the “TOUR” and “Wandering Earl, LLC” that may contain the Client in part or in whole. I agree that these images may be reproduced by THE RELEASEES and grant perpetual, royalty-free, worldwide, irrevocable license to reproduce such images, photos or video in any medium for promotion and publicity purposes.

PASSPORT AND VISAS
I assume complete responsibility for, and hereby release THE RELEASEES from any duty of checking and verifying any and all passport, visa, vaccination or other entry requirement of each destination, and all safety and security conditions at such destinations, during the length of the proposed and actual travel. Requirements for entry and exit to various countries and territories may change from time to time, and it is my responsibility to assume all such obligations. THE RELEASEES are not responsible for the individual acts of customs or governmental agents who may refuse me entry or exit into the country.

PAYMENT/REFUND TERMS
I have read and understood the payment terms for this “TOUR”. A deposit is required to secure my spot on this “TOUR”. The deposit amount is refundable for the number of days specified on the website where the tour is advertised, the tour booking page and/or the payment page. The payment of the balance amount for this “TOUR” is due 90 days prior to the start date of the “TOUR”. If the payment for the balance is late, it will incur a 6% late fee.

Once the balance amount is paid, I am entitled to a 50% refund of the balance amount if I cancel the tour between 60 – 89 days prior to the start date of the “TOUR”. Within 59 days of the start date of the “TOUR”, the balance amount is non-refundable.

Once a “TOUR” begins, “Wandering Earl, LLC” is unable to provide any refunds for any part of the tour. If a scheduled activity, meal or experience is not possible or is removed from the itinerary or changed to another activity, meal or experience – whether due to weather, transportation delays, natural disasters, time constraints, the decision of the tour leader and more – the cost associated with that original portion of the tour will not be refunded.

If a tour participant decides not to participate in any scheduled activity, meal or experience, or decides to end their participation in the tour for any reason before it is complete, no refund will be given for any missed activity, meal, experience or any other portion of the tour. In addition, no compensation will be given for any expenses incurred by a participant that decides to end their participation in the tour before it is complete. This includes expenses for accommodation, flight changes, transportation of any type, meals and more.

Please note: If you make a booking for a spot in a twin or double room on any “TOUR”, which involves sharing that room with another traveler, either known to you or unknown to you but that booked a spot in the same type of room, and we are not able to find another person to share your room, you will be required to pay the single supplement amount. As a result, you will then have a single room throughout the duration of the”TOUR”.

I have carefully read and understood this agreement prior to filling out the form below that confirms my agreement.

I am aware that submitting the form below waives certain legal rights against “Wandering Earl, LLC”.
